So lets see, we have underage drinking ('spent my 21st birthday in jail', after a weekend party),

If you are going to quote me, then quote the whole thing. This accident happened about 24 hours after I had my last drink. I spent time in jail becuase they didn't take the time to find out, they just ASSumed I was drunk, they ASSumed I had no insurance, they ASSumed I was driving too fast.

But to keep the record straight, I'm not down on LEO's, my wife is one. But some are lazy and don't do their jobs correctly. This is some, not most. Definately an exception to the rule.

..spotlighting (sorry, but shine a spot light around with a gun in your vehicle and you are illegal)

No you aren't. Even the idiot who gave me the ticket knew that you can do it with a shotgun. There is a law that says if you have both in your vehicle and are in an area where "game" lives it can be prima-facie evidence that you are poaching. But I was not in an area where there is game. I was in an area where there are Jack Rabbits. From the proclamation "Jack Rabbits are not protected in Utah, they may be hunted at any time with any weapon" Add to that the fact that I had 9 months of LEO's telling me I was ok doing the same thing in the same area and 10 years of doing the same thing in the same area....

And yes she is the bad guy, I've talked to several of her coworkers and they agree.

Yes, it does... :( I'm reminded practically every second of my life, too. Memory loss, severe back pain, major headaches to the point of passing out or throwing up, etc.

I made that quote after reading just that line and thinking you made a typo leaving out "involved"

. I started partying Friday night and have people that know of me not stopping until Sunday morning when I went home to get ready for work. I then worked the graveyard shift and then was going to?...... I spent my 21st b'day in jail over the accident.

Sounds like underage drinking, but I could be reading more into it. If you had not been drinking, my apology for the accusation.

Depending on exactly were you are, that may or may not be a court battle I would want.

Looking at the Big Game Proclamation (pg 14)

(a) A person may not use or cast the rays of any spotlight, headlight or other artificial light to locate protected wildlife while having in possession a firearm or other weapon or device that could be used to take or injure protected wildlife; and

(b) the use of a spotlight or other artificial light in a field, woodland or forest where protected wildlife are generally found is prima fascie evidence of attempting to locate protected wildlife.

Fact that your weapon was a shotgun is irrelevant and considering the fact that many areas with jackrabbits (NOT a protected species as you pointed out) overlap with deer, antelope and other animal ranges (esp in winter and spring), you may have a heck of a time in court. Changes in season alone over the past nine months could make the difference if deer winter in the area.

Underage drinking, yes. Had nothing to do with my accident, though. Like I said I had not had any alcohol or drugs (not that I was doing drugs at the time) for about 24 hours prior to the accident. The officer had NO way to know I was drinking, or sober. He had no way of knowing anything about how the accident happened. There were no skid marks on the pavement, there were no open or closed containers. My point is that he ASSumed I was drunk. He ASSumed I was speeding and he ASSumed I did not have insurance. But he had absolutely no issues in smearing my name in the mud as a drinking, hot rodder that was irrisponsible with no insurance.

Heck, he was so good about his 'investigation' I was labeled John Doe for about 2-3 days after the accident and in the police report I was older? than I actually was.

You should study a bit more before you try to argue about something you are insufficiently informed on. Go read a fur bearer's proc. Besides, proclamations aren't law, they often talk about laws in them, but everything in them is not law, a lot of it only applies to hunters.

I'm not going to argue this with you anymore, the fact is she is a c*** and I shouldn't have gotten a ticket.

LOL, sounds like she got to you just a wee bit

We got her back that night :greg: We drove back towards town and stopped off near Cedar Fort and drove around my friends property acting like we were spotlighting again. They bounced down the road and pulled up next to us with the window down, you could hear her cackling away at how she caught these dumb criminals at it again... that is you could hear her until my friend started yelling at the both of them for trespassing and driving off the road over the vegetation. The best part of that was that you know she got back on the road and realized that we had baited her, and she had bitten.
She is not my favorite person, I will party the day she gets fired.

I hate the fact that because I am young, drive I nice car when not in my 4x4, and work odd hours I get pulled over 3-4x a month.. and once 13x in a week. the usual excuses I get are as follows:
--You were driving 25MPH in a 25MPH zone, no one drives the speed limit unless they are up to something

--Where are you going at 2am (Home).. Ok

--I pulled you over because this car does not fit your profile

--you ran that stop sign...(officer do you mean I took the right turn without stopping when the sign says right turn permitted without stopping)..Dont be a smart ass heres your ticket..... Three weeks later in court, after missing a day of work: All charges dropped because... WOW.. I was right.
This has happened 4 times now.

--Going 36 in a 35 zone (true I was speeding, but COME ON... the difference between new and old tires can account for that)

--Windshield wipers were going to slow...(Sorry officer, they only have 1 speed)

and my personal favorite

-- Oh, sorry, I should know its you by now

Now I am all for cops, and I under stand they get alot of dangerous people off the road this way, but can I PLEASE drive home this week without getting stopped. And thanks for at least usually not ticketing me

You were not stopped for going 25 in a 25 or your wipers were too slow, and if so when and where I PERSONALLY would like to verify this.

Nice 1st post too :-\

and once 13x in a week.

So you got stopped twice a day? What were you doing wrong? I'm sorry, I just can't buy that you got stopped that much and it was all for nothing.
Why do people think it's 'cool' to have been stopped alot? I take pride in the fact that in the nearly nine years that I've been driving I've been pulled over maybe seven times, and all for legitimate reasons. I took the tickets and paid the fines because I was in the wrong and I got caught.
Twice a day? Fix your car, stop speeding, obey the laws and fix your attitude and chances are you would avoid that problem.

I can see the arguement "but judge, I can spotlight, I am not a hunter..."

Anyway, I wasn't there, am not a lawyer or cop. But my simple point is that, as other have said, an awful lot of bad run in with cops (of course not all) have more to do with the person stopped than the cop.
